IN RE ROBERT EGNATUK, Relator

ORIGINAL PROCEEDING WRIT OF MANDAMUS
257th District Court Harris County, Texas
Trial Court Cause No. 2015-49789

MEMORANDUM OPINION

On Friday, November 15, 2019, relator Robert Egnatuk filed a petition for writ of mandamus in this Court. See Tex. Gov't Code Ann. § 22.221; see also Tex. R. App. P. 52. In the petition, relator asks this Court to compel the Honorable Sandra Peake, presiding judge of the 257th District Court of Harris County, to vacate her October 14, 2019 order entitled "Order Dismissing Motion to Enforcement" ("the Order").

Relator included a copy of the two-page Order in the appendix to his petition for writ of mandamus. See Tex. R. App. P. 52.3(k)(1)(A) (appendix to petition for writ of mandamus must contain "a certified or sworn copy of any order complained of, or any other document showing the matter complained of"). The second page of the Order, which appears to reflect the trial court's findings, is illegible. On November 15, 2019, we requested the relator to file a legible copy of the Order no later than 10:00 a.m. on Friday, November 22, 2019. No such copy has been received.

A relator bears the burden to provide a sufficient record to establish he is entitled to relief. In re Henry, 525 S.W.3d 381, 382 (Tex. App.—Houston [14th Dist.] 2017, orig. proceeding). Relator has failed to do so. Therefore, we deny relator's petition for mandamus.

PER CURIAM Panel consists of Chief Justice Frost and Justices Christopher and Bourliot.
