ORDER DENYING MOTION FOR RECONSIDERATION
This case comes before the Court on Debtor's "Motion for Reinstatement of Case," filed on December 4, 2006 (Docket # 19), which this Court construes as a motion for reconsideration, and
The Court having reviewed and considered the motion for reconsideration, and
The Court finds the motion fails to demonstrate a palpable defect by which the Court and the parties have been misled, and that a different disposition of the case must result from a correction thereof. See Local Rule 9024-1(c).
In addition, the Court notes that, contrary to the allegation in paragraph 3 of the motion, no credit counseling certificate was attached to the Official Form 1, Exhibit D filed on November 5, 2006 (Docket #14). No credit counseling certificate was timely filed, despite the Clerk's October 23, 2006 notice that this document was missing and was due no later than November 7, 2006 (Docket #6). No such certificate was filed until December 4, 2006 (attached to Docket #19), almost 3 weeks after the case was dismissed.
The Court further notes that it could not grant the stay relief requested by the two stipulations recently filed (Docket ##24 and 25) in any event, because the Chapter 7 trustee has not stipulated to such stay relief.
NOW, THEREFORE,
IT IS ORDERED that the motion for reconsideration should be, and hereby is, DENIED.
