ORDER

The clerk's record, the reporter's record, the appendix to appellant's brief, and appellee's brief have been filed under seal. Although appellant's brief was not filed under seal, it has not been posted to the Court's website. Both briefs discuss the trial court's findings of fact which support the order on appeal. Neither brief, however, indicates what facts and evidence should be considered confidential and under seal.

This Court must hand down a public opinion explaining our decisions based on the record. See TEX. R. APP. P. 47.1, 47.3 (all opinions are open to the public and must be made available to public reporting services); TEX. GOV'T CODE ANN. § 552.022(a)(1) (West 2012) ("final opinions, including concurring and dissenting opinions, and orders issued in the adjudication of cases" are "public information"). This we cannot do without mentioning the key documents and certain specific facts.

Therefore, the parties are DIRECTED to advise the Court, by February 20, 2018, which documents and facts are deemed unsealed for purposes of this appeal.
