ORDER OF DISMISSAL


On this date, the Court entered an Opinion Relating to Appeals From and Motions Regarding the Bankruptcy Court's November 30, 1999 Confirmation Order. On April 12 and 13, 2000, hearings were held on the matter. For the reasons set forth in the Opinion Relating to Appeals From and Motions Regarding the Bankruptcy Court's November 30, 1999 Confirmation Order,

IT IS ORDERED that the Appellees' Motion Requesting that a Procedure be Established for Oral Argument Leave to Appeal Interlocutory Order (Docket No. 0-1, filed March 17, 2000) is MOOT given that the Court entered an Order Setting Procedure for Oral Argument dated April 7, 2000.

IT IS FURTHER ORDERED that the Appellant's Motion to Dismiss Appeals of Dow Chemical, Inc., Corning, Inc., Official Committee of Tort Claimants and Dow Corning, Inc. with exhibits (Docket Nos. 5-1 and 5-2, filed January 14, 2000) is DENIED.

IT IS FURTHER ORDERED that the Bankruptcy Court's November 30, 1999 Confirmation Order is AFFIRMED.

IT IS FURTHER ORDERED that this Appeal is DENIED and DISMISSED.
