Opinion

No. 01-07-00034-CV

Opinion issued May 3, 2007.

Original Proceeding on Petition for Writ of Mandamus.

Panel consists of Justices TAFT, ALCALA, and HANKS.

MEMORANDUM OPINION

By petition for writ of mandamus, relator, Ralph O. Douglas, challenges the trial court's failure to grant default judgment in his favor, failure to set a trial date, and grant of a protective order in favor of the real party in interest. On March 6, 2007, we sent Douglas a letter by certified mail, informing him that the court had not received either the filing fee or an affidavit of indigency and giving him until April 20, 2007, to respond to the Court's letter. Douglas did not respond.

We dismiss the petition for writ of mandamus.
