IN RE DOLGENCORP OF TEXAS INC. D/B/A DOLLAR GENERAL CORPORATION

On Petition for Writ of Mandamus.

ORDER

Before Justices Benavides, Longoria, and Tijerina
OrderPer Curiam

Currently before the Court is an "Agreed Motion to Abate and Partially Lift Stay." Relator Dolgencorp of Texas Inc. d/b/a Dollar General Corporation had filed a petition for writ of mandamus and a motion for temporary relief in the above cause. This Court granted the motion for temporary relief, ordered all trial court proceedings to be stayed, and requested that the real party in interest, Luciana Ramirez, or any others whose interest would be directly affected by the relief sought, file a response to the petition for writ of mandamus. However, according to the agreed motion, the parties to this petition for writ of mandamus "have reached an agreement to resolve the Rule 202 proceeding and thus request that this Court abate the original proceeding and partially lift the stay so that the parties may present the trial court with their agreement and proposed order vacating the challenged orders." See TEX. R. CIV. P. 202.

The Court, having examined and fully considered the agreed motion, is of the opinion that it should be granted. Accordingly, we grant the "Agreed Motion to Abate and Partially Lift Stay." We lift our previously ordered stay for the limited purpose of allowing the trial court to consider and sign the parties' proposed order vacating the challenged orders. The stay remains in effect as to all other matters. We abate this original proceeding for a period of thirty days. We direct relator to file a motion prior to the end of this period advising the Court regarding whether the abatement should be extended, or whether the petition for writ of mandamus should be reinstated and addressed on the merits, or whether the petition for writ of mandamus should be dismissed.

IT IS SO ORDERED.

PER CURIAM Delivered and filed on the 12th day of January, 2021.
