Before Justices WHITTINGTON, BRIDGES, and RICHTER.

MEMORANDUM OPINION

This appeal has been pending since March 17, 2006. By separate letters dated March 20, 2006, we notified appellant Ray Porter that his $125 filing fee and the docketing statement were due, and that his notice of appeal was defective. Appellant was directed to pay the filing fee and file the docketing statement within ten days and to file an amended notice of appeal within thirty days. We cautioned appellant that if he failed to comply with the Court's instructions, the appeal would be dismissed.

Nevertheless, to date, appellant has not paid the $125 filing fee or filed an amended notice of appeal or the docketing statement. Accordingly, we DISMISS the appeal. See Tex.R.App.P. 42.3 (c).
