Jerry J.G., Jr., having moved for permission to proceed as a poor person and for assignment of counsel on an appeal sought to be taken herein from a Judicial Surrender executed and acknowledged before the Family Court, Monroe County, on January 22, 2008,

Now, upon reading and filing the affidavit of Jerry J.G., Jr., sworn to August 20, 2013, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is dismissed.
