No. 05-08-01690-CV

Opinion Filed January 7, 2009.

Original Proceeding from the 194th Judicial District Court, Dallas County, Texas, Trial Court Cause No. F99-70976.

MEMORANDUM OPINION

Relator contends the trial judge violated a ministerial duty by denying relator's motion for back time credit. The facts and issues are well known to the parties, so we need not recount them herein. Based on the record before us, we conclude relator has not shown he is entitled to the relief requested. See Tex. R. App. P. 52.8(a); In re State ex rel. Young v. Sixth Judicial Dist. Court of Appeals at Texarkana, 236 S.W.3d 207,(Tex.Crim.App. 2007); State ex rel Hill v. Court of Appeals for Fifth Dist., 34 S.W.3d 924 (Tex.Crim.App. 2001). Accordingly, we DENY relator's petition for writ of mandamus.
