Appeal from Original Proceeding.

Before Chief Justice GRAY, Justice VANCE, and Justice REYNA.

MEMORANDUM OPINION

Patrick Day, an inmate with a pending charge of aggravated sexual assault, filed a petition for writ of mandamus against the judge of the 66th District Court of Hill County, his own attorney, and the State's attorney. We have no mandamus jurisdiction over Day's attorney and the State's attorney. See TEX. GOV'T CODE ANN. § 22.221 (Vernon 2004). Further, Day has failed to present a record upon which relief by mandamus can be granted. TEX. R. APP. P. 52.7(a). Therefore, we dismiss the petition as to Day's attorney and the State's attorney for want of jurisdiction and deny the petition as to the trial court judge.
