ORDER

AND NOW, this day of , 2016, upon consideration of Samuel C. Stretton's Motion to Withdraw as Counsel for the Respondent, David Tidd, it is hereby ORDERED and DECREED that the said Motion in GRANTED and Samuel C. Stretton, Esquire is removed as counsel for David Tidd.

J. MOTION OF SAMUEL C. STRETTON , ESQUIRE TO WITHDRAW AS COUNSEL FOR THE RESPONDENT, DAVID W. TIDD

Samuel C. Stretton, Esquire respectfully requests to withdraw as counsel for former judge David Tidd in the captioned matter for the following reasons:

1. Mr. Stretton was retained by David Tidd and has represented him until Friday, November 4, 2016.

2. Mr. Stretton was preparing for trial when he received an email on Friday, November 4, 2016 from David Tidd, telling him that he was discharging Mr. Stretton and hiring attorney Philip Lauer. Mr. Lauer is an excellent and well respected lawyer who Mr. Stretton knows.

3. Mr. Stretton called and wrote David Tidd to find out what went wrong, but has not received any response.

4. Mr. Stretton telephoned Elizabeth Flaherty of the Judicial Conduct Board on Friday, November 4, 2016, and advised her that he was discharged and would be filing a Motion to Withdraw based on the discharge.

5. Mr. Stretton, therefore, asks that this Honorable Court allow him to withdraw since David Tidd has discharged him for whatever reasons and has apparently retained new counsel, and Mr. Stretton can no longer play any role since his client no longer wishes for Mr. Stretton's representation.

6. Mr. Stretton has the two boxes of discovery provided him, which he has made available for Mr. Tidd or Mr. Lauer to pick up after making arrangements to do so.

WHEREFORE, Samuel C. Stretton, Esquire, respectfully requests this Honorable Court allow him to withdraw as counsel since David Tidd has discharged him and for whatever reason no longer wishes for Mr. Stretton's representation.
