ORDER
Before Justices Bridges, Whitehill, and Boatright
Before the Court is the November 15, 2018 petition for writ of mandamus filed by Dallas Plastic Surgery Institute, Inc. and Dallas Day Surgery Center, Inc. ("the November 15 petition"). Also before the Court is the November 21, 2018 petition for writ of mandamus filed by Sameer Subhash Jejurikar, M.D., and Sameer Subhash Jejurikar, M.D., P.A. ("the November 21 petition"), which was originally docketed as cause number 05-18-01417-CV but was consolidated into this original proceeding by order dated November 27, 2018.
We request that Sameer Subhash Jejurikar, M.D., Sameer Subhash Jejurikar, M.D., P.A., and Respondent file their responses, if any, to the November 15 petition by December 11, 2018.
We also request that Dallas Plastic Surgery Institute, Inc., Dallas Day Surgery Center, Inc., and Respondent file their responses, if any, to the November 21 petition by December 11, 2018.
We further request that the responses include discussion and analysis of (i) whether there is an exception to rule 509's physician patient privilege and (ii) the interplay, if any, between rule 509 and Occupations Code section 159.003(12)'s court order exception to section 159.002's proscriptions. TEX. R. EVID. 509; TEX. OCC. CODE ANN. §§ 159.002, 159.003(12).
