SCHEDULING ORDER No. 19


All counsel for all cases in this multi-district litigation having participated in a conference call on July 14, 2005, this Court orders as follows:

1. Plaintiffs will propose replacement class representatives for the putative Providian and Diners Club subclasses by August 4, 2005;
2. All discovery, including depositions, with respect to plaintiffs' proposed replacement class representatives will be completed by August 18, 2005;
3. Plaintiffs will move to name lead plaintiffs for the putative Providian and Diners Club subclasses by August 23, 2005;
4. Defendants will file and serve their opposition, if any, by September 1, 2005;
5. Plaintiffs will file and serve their reply, if any, by September 8, 2005;
6. Oral argument on plaintiffs' motion to name the lead plaintiffs is scheduled for September 9, 2005 at 4:00 p.m.;
7. Plaintiffs will file and serve their supplemental plan for class action notice by September 30, 2005;
8. Defendants will file and serve their opposition to plaintiffs' plan for class action notice by October 28, 2005;
9. Plaintiffs will file and serve their reply papers in support of their plan for class action notice, if any, by November 28, 2005;
10. Oral argument on class action notice will be scheduled after a ruling by the Court of Appeals for the Second Circuit on the interlocutory appeals pending before it;
11. The briefing schedule for the parties' motions for summary judgment is stayed pending further notice; and
12. The trial in these consolidated actions shall commence on May 15, 2006.
SO ORDERED.
