Opinion

MDL No. 1409.

February 18, 2005

Dear Judge Pauley:

At Chamber's suggestion, I write on behalf of plaintiffs and defendants Visa U.S.A. Inc., Visa International Service Association, and MasterCard International Incorporated (collectively, the "Networks") regarding Scheduling Order No. 13. The parties continue to engage in efforts to resolve a number of the remaining issues with respect to plaintiffs' responses to the Networks' Requests For Admission. Plaintiffs have agreed to provide supplemental responses to certain of the requests by March 11, 2005.

Accordingly, in an effort to reach agreement on these issues and avoid unnecessary motion practice, the parties respectfully request the Court's permission for a moderate extension of time for the filing of the Network Defendants' motion to compel (currently due on February 24, 2005). With the Court's approval,we respectfully request that the Network Defendants' motion to compel, if necessary, now be due on March 25, 2005, the plaintiffs' opposition now be due on April 8, 2005, and the Network Defendants' reply, if any, now be due on April 15, 2005. Plaintiffs and all of the Network Defendants concur with this request.

SO ORDERED.
