In re Guardianship of Jose Daniel Vargas Cubias

LC No. 22-002544-GM

ORDER

Elizabeth L. Gleicher, Chief Judge, acting under MCR 7.203(F)(1), orders:

The motion to waive fees is GRANTED for this appeal only.

The claim of appeal is DISMISSED for lack of jurisdiction. This Court lacks jurisdiction over the claim of appeal from the July 27, 2022 order regarding appointment of guardian of a minor because appellant is not aggrieved by that order. MCR 7.203(A); MCR 5.801(A). Additionally, this Court lacks jurisdiction over the claim of appeal from the proposed "order for special findings of fact and conclusions of law." The proposed order is not signed and dated by the probate court judge; therefore, it is not a valid order of the probate court. See MCR 5.801(A); 2.602(A)(1). See also Tiedman v Tiedman, 400 Mich. 571, 576; 255 N.W.2d 632 (1977).
