On Appeal from the 302nd Judicial District Court Dallas County, Texas Trial Court Cause No. DF-14-07021

ORDER

KEN MOLBERG, JUSTICE.

We REINSTATE this appeal which we previously abated to allow the trial court to file findings of fact and conclusions of law.

Before the Court is appellants' May 8, 2023 motion for an extension of the deadline to file a request for additional and/or amended findings of fact and conclusions of law. Appellants explain in their motion that the trial court signed findings of fact and conclusions of law on April 19th, five days after the deadline imposed by this Court's April 3rd order. Appellants however, did not learn that the trial court had signed findings of fact and conclusions of law until May 6th. As a result, appellants missed the April 24th deadline set in our April 3rd order to request additional and/or amended findings of fact and conclusions of law.

Appellants ask this Court to extend the deadline for such request. We GRANT the motion. Appellants shall file, on or before May 16, 2023, any request for additional and/or amended findings of fact and conclusions of law. We ORDER the trial court to make any additional and/or amended findings and conclusions or provide written verification that additional findings and conclusions are not appropriate on or before May 26, 2023.

We ORDER Dallas County District Clerk Felicia Pitre to file, on or before June 5, 2023, a supplemental clerk's record containing (1) any request for additional or amended findings and conclusions, (2) any additional or amended findings and conclusions signed by the trial court, or (3) written verification from the trial court that additional findings and conclusions are not appropriate.

We DIRECT the Clerk of this Court to send a copy of this order to the Honorable Sandra Jackson, Presiding Judge of the 302nd Judicial District Court; Ms. Pitre; and, the parties.

We ABATE this appeal to allow the trial court an opportunity to comply with this order. The appeal will be reinstated in thirty-five days or when the requested supplemental clerk's record is filed, whichever occurs sooner.
