MOTION DECISION

PRESENT:Hon. Dianne T. Renwick, Cynthia S. Kern Jeffrey K. Oing Peter H. Moulton Manuel J. Mendez, Justice Presiding, Justices.

An appeal having been taken to this Court from the judgment of the Supreme Court, New York County, rendered on or about November 7, 2019, which convicted defendant of criminal contempt and directed that he be incarcerated for a period of 30 days, and from the order, same court, And defendant-appellant having moved for an order further extending the stay of execution of judgment, granted by the Hon. Robert Stolz, Supreme Court, New York County, pending hearing and determination of the aforesaid appeal from the judgment, and extending the time in which to perfect the appeal (See Order, M-2020-03207, entered November 17, 2020) (M-2021-01902), And a Certificate having been entered simultaneously herewith granting defendant leave to appeal from the order, same court, entered on or about April 5, 2021 (see M-2021-01892, Case No. 2021-01966), Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is granted to the extent of extending the aforesaid stay of execution of judgment, upon the original terms and conditions, and on the further condition that defendant perfects his appeals for the December 2021 Term.
