Opinion

No. 14-09-00368-CV

Memorandum Opinion filed April 23, 2009.

Original Proceeding Writ of Mandamus.

Panel consists of Chief Justice HEDGES and Justices YATES and FROST.

MEMORANDUM OPINION

On April 21, 2009, relators, Theodora Christina Costa, Roberta Penelope Costa, and John Louis Gavrel, as Next Friends of Louis John Gavrel, filed a petition for writ of mandamus in this court. See Tex. Gov't Code Ann. § 22.221 (Vernon 2004); see also Tex. R. App. P. 52. In the petition, relators ask this court to compel the Honorable Dan Hinde, presiding judge of the 269th District Court, and the Honorable Tracy Christopher, Administrative Judge of the Civil Trial Division of Harris County, to transfer the underlying case back to the 11th District Court of Harris County. Relators also filed a motion to stay the commencement of trial on April 27, 2009.

Relators have not established their entitlement to the extraordinary relief of a writ of mandamus. Accordingly, we deny relators' petition for writ of mandamus and motion to stay the commencement of trial.
