Opinion

No. 05-06-00208-CV

Opinion issued February 23, 2006.

Original Proceeding from the 219th Judicial District, Collin County, Texas, Trial Court Cause No. 219-01195-05.

Writ of Mandamus Denied.

Before Justices WRIGHT, O'NEILL and LANG.

MEMORANDUM OPINION

Relator contends the trial court erred in denying his motion regarding the deposition of a third party to the underlying suit. The facts and issues are well known to the parties, so we need not recount them here. Based on the record before us, we conclude relator has not shown he is entitled to the relief requested. See Tex.R.App.P. 52.8(a); Walker v. Packer, 827 S.W.2d 833, 839-44 (Tex. 1992) (orig. proceeding). Accordingly, we DENY relator's petition for writ of mandamus.
