May 22, 2003.

Consideration, by the Court of Appeals, on its own motion pursuant to NY Constitution, article VI, § 22 and Judiciary Law § 44 (8) of whether Honorable Gerald P. Garson should be suspended from his office of Justice of Justice of the Supreme Court of the State of New York, Second Judicial District.

Chief Judge Kaye and Judges Smith, Ciparick, Wesley, Rosenblatt, Graffeo and Read concur.


On the Court's own motion, it is determined that Hon. Gerald P. Garson is suspended, without pay, effective immediately, from the office of Justice of the Supreme Court of the State of New York, Second Judicial District, pursuant to New York State Constitution, Article 6, section 22 and Judiciary Law, section 44, subd. 8.
