On order of the Court, the application for leave to appeal the April 30, 2002 decision of the Court of Appeals is considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we VACATE the decision of the Court of Appeals and REMAND this matter to the Ingham Circuit Court which shall hear the matter as an appeal of right. That court may order supplemental briefing and hear oral argument. The Court of Appeals lacked subject matter jurisdiction. Lotel, Inc v PSC, 255 Mich. App. 454 (2003).
