CONTINUING ABATEMENT ORDER
The court abated this appeal on October 13, 2015, and continued the abatement on December 2, 2015, for the trial court to effectuate the parties' settlement agreement. On February 1, 2016, counsel for appellant notified the court that the parties have completed the documents required to effectuate their settlement, and the documents will be filed in the trial court this week for the trial court's signature. Counsel requested the abatement continue for two weeks. The request is GRANTED.
Accordingly, appeal remains ABATED to permit the trial court to conduct further proceedings to effectuate the parties' agreement. The appeal is treated as a closed case, and removed from this court's active docket until February 16, 2016. The parties are advised that appellant must file a motion to reinstate and dismiss this appeal no later than February 16, 2016, or, if the agreement has not been effectuated by that date, appellant is required file a report with this court giving the status of the proceedings in the trial court and requesting an extension of the abatement. The failure to file a motion to reinstate and dismiss the appeal or a status report by February 16, 2016, may result in the dismissal of this appeal without further notice.
