IN RE C.D., Relator

ORIGINAL PROCEEDING WRIT OF MANDAMUS 310th District Court Harris County, Texas Trial Court Cause No. 2009-00064

Panel consists of Justices Wise, Spain, and Hassan.

MEMORANDUM OPINION

PER CURIAM.

On November 12, 2021, relator C.D. filed an amended petition for writ of mandamus in this court. See Tex. Gov't Code Ann. § 22.221; see also Tex.R.App.P. 52.

Relator is a party to the underlying suit to modify the parent-child relationship. Although relator initially had counsel, who filed the suit on relator's behalf, relator, who is a Texas licensed attorney, subsequently designated herself as lead counsel with her original counsel continuing to represent relator as local counsel. Real party in interest D.D. objected to relator's designation of herself as lead counsel. The Honorable Charles Collins, associate judge of the 310th District Court of Harris County, signed an order on October 21, 2021, directing that all communications and filings be sent to relator's original counsel. In this original proceeding, relator requests that this court compel Judge Collins to set aside his October 21, 2021 order.

Relator has appealed Judge Collins's order to the presiding judge, who will hear the de novo appeal on November 19, 2021. At this time, we dismiss relator's amended petition as premature without reaching the merits. We also deny relator's motion to stay.
