ORDER MODIFYING OPINION; CHANGE IN JUDGMENT; PETITION FOR REHEARING DENIED

THE COURT

It is ordered that the opinion filed herein on May 13, 2008, and not certified for publication, be modified as follows:

On the title page, replace the word “affirmed” with “affirmed as modified.”

On page 2, first paragraph, the last sentence reads “We affirm.” It should read: “We affirm as modified.”

On page 10, at the end of the first full paragraph (starting with The Department concedes), a sentence should be added stating: “Accordingly, the court is directed to strike the section 300, subdivision (j) finding.”

On page 14, the disposition should read: “The order is affirmed as modified. The juvenile court is directed to strike the section 300, subdivision (j) jurisdictional finding.”

The foregoing does effect a change in the judgment. The petition for rehearing is denied.
