MEMORANDUM OPINION

Before QUINN, C.J., and CAMPBELL and PIRTLE, JJ.

On December 29, 2015, relator Bernard's Advanced Collision, L.L.C. filed a petition for writ of mandamus against respondent, the Honorable Ana Estevez, judge of the 251st District Court of Potter County. According to relator's petition, this proceeding arises from an underlying lawsuit filed by real party in interest, State Farm Mutual Auto Insurance Company.

After filing its petition, and also on December 29, relator filed a motion requesting dismissal of this proceeding. In the motion, relator states the parties have settled their dispute. An attached certificate of conference indicates counsel for State Farm does not oppose the requested dismissal.

Accordingly, this original proceeding is dismissed. Any additional relief requested is denied.
