ORDER Trial court case number: 2019-17683 Trial court: 234th District Court of Harris County

Pursuant to our June 23, 2020 abatement order, on September 3, 2020, the trial court clerk filed a supplemental clerk's record which contains the trial court's final sealing order, stating that the parties and the trial court have complied with the procedures to seal court records pursuant to Rule 76a and that exhibits 1 and 4 should be sealed. See TEX. R. APP. P. 76a. On September 4, 2020, relator filed an unopposed motion to seal and reinstate, requesting that we only seal exhibits 1 and 4 and reinstate the case. Relator points out that exhibits 1 and 4 are currently located in Volume 2 of the mandamus record, which also includes other documents not subject to the trial court's sealing order.

Accordingly, we grant relator's unopposed motion to seal and reinstate. Because Volume 2 of the mandamus record is currently sealed and does not segregate between unsealed documents and sealed exhibits, we strike Volume 2. Relator may refile Volume 2, containing the unsealed documents, and a sealed Volume 3, containing the sealed exhibits. See TEX. R. APP. P. 52.7.
