Opinion

No. 05-05-00491-CV

Opinion issued May 10, 2005.

Original Proceeding from the County Court at Law No. 3, Dallas County, Texas, Trial Court Cause No. CC-03-15431-C.

Writ of Mandamus Denied.

Before Justices MOSELEY, BRIDGES, and FRANCIS.

MEMORANDUM OPINION

The facts of this original proceeding are known to the parties so we do not recite them here. Relator contends the trial judge abused her discretion in issuing an order of clarification and final judgment because the county court never acquired jurisdiction over the case. We disagree and deny relator's petition for writ of mandamus. See Walker v. Packer, 827 S.W.2d 833, 839-842 (Tex. 1992) (orig. proceeding); Argonaut Underwriters Ins. Co. v. Ellis, 320 S.W.2d 917, 918 (Tex.Civ.App.-Eastland 1959, no writ); Hervey v. Forse, 253 S.W.2d 701, 703 (Tex.Civ.App.-Beaumont 1952, no writ); Dugger v. Banner, 87 S.W.2d 792, 794 (Tex.Civ.App.-El Paso 1935, no writ).
