The attached provision is necessary to implement Section 7 of Chapter 286, Laws 2008, which is effective September 26, 2008 and authorizes the Supreme Court to increase the Class A and B filing fees established by A.R.S. §§ 12-119.01 and 12-120.31 for the appellate courts in Arizona. The enactment responds to a request from the Legislature to assist in meeting the current budget crisis and, therefore, requires adoption pursuant to A.C.J.A. § 1-201 (E) prior to distribution for comment and recommendation by the Arizona Judicial Council.

Now, therefore, pursuant to Article VI, Section 3, of the Arizona Constitution,

IT IS ORDERED that the above-captioned provision, attached hereto, is adopted as a section of the Arizona Code of Judicial Administration effective October 1, 2008.

ARIZONA CODE OF JUDICIAL ADMINISTRATION Part 2: Appellate Courts Chapter 3: Administration Section 2-301: Appellate Court Fees

A. Purpose. A.R.S. § 12-119.01 (C) provides, "The supreme court may increase the Class A and B fees prescribed in subsection A of this section." A.R.S. 12-120.31 (A) provides, "Fees and costs in the court of appeals shall be the same as supreme court fees and costs pursuant to § 12-119.01." This section establishes the current Class A and B fees and reflects the rest of the fees established by statute for the Supreme Court and Court of Appeals.

B. Fees. The Clerks of Court for the Supreme Court and the Court of Appeals shall collect the following fees unless they are waived as provided in Arizona Code of Judicial Administration § 5-206:Class Description Fee
