ORDER DENYING PETITION FOR REHEARING

On September 28, 2005, Mario Sims, the petitioner in the above matter, filed with this Court a Petition for Rehearing. Sims tendered an amended Petition for Rehearing on October 3, 2005, and a motion for leave to file an amended petition on October 12, 2005.

And this Court, being duly advised, now finds that said amended Petition for Rehearing should be denied.

IT IS, THEREFORE, ORDERED, that the amended Petition for Rehearing is DENIED.
