Defendant having moved, pursuant to CPL § 330.20 (21) (a) (ii) for leave to appeal from orders of the Oneida County Court, dated October 25, 2021, and September 17, 2021, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is hereby ORDERED that the motion is granted insofar as it seeks leave to appeal to the order entered October 25, 2021, and

It is further ORDERED the motion insofar as it seeks leave to appeal from the order dated September 17, 2021, is denied without prejudice to a new motion demonstrating that the motion seeking leave to appeal the order dated September 17, 2021, was timely served and filed pursuant to CPLR 5513 (b).
