ORDER

PER CURIAM

On March 24 and April 14, 2023, this court ordered Appellant Brittany Nicole Smith to provide a reasonable explanation for filing a late notice of appeal. See generally Verburgt v. Dorner, 959 S.W.2d 615, 617 (Tex. 1997). On April 21, 2023, Appellant Smith filed her explanation, which showed that the notice of appeal was not deliberately filed late. See Garcia v. Kastner Farms, Inc., 774 S.W.2d 668, 670 (Tex. 1989) (citing Meshwert v. Meshwert, 549 S.W.2d 383 (Tex. 1977)).

Appellant's motion for extension of time to file a notice of appeal is granted. Appellant's notice of appeal is deemed timely filed. See id. R. 26.3.

It is so ORDERED.
