Opinion

82-114

Opinion delivered June 21, 1982

On November 5, 1973, 255 Ark. 1075, in accordance with a petition from the Arkansas Judicial Council, the Code of Judicial Conduct of the American Bar Association was approved by per curiam order as the proper standards for the Judiciary of this State.

The section entitled "Compliance with the Code of Judicial Conduct," p. 31, reads in pertinent part:

A. Part-time Judge. A part-time judge is a judge who serves on a continuing or periodic basis, but is permitted by law to devote time to some other profession or occupation and whose compensation for that reason is less than that of a full-time judge. A part-time judge:

. . . .

(2) should not practice law in the court on which he serves or in any court subject to the appellate jurisdiction of the court on which he serves as a judge or in any other proceeding related thereto.

It has been suggested to the court that Section A (2) be amended to read as follows:

should not practice in the court on which he or she serves or any other court whose jurisdiction is coextensive with his or her court, both as to territory and subject matter; that he or she will not appear as counsel in any case which could originate or rise in the court over which he or she presides.

Permission is hereby granted to the Arkansas Municipal Judges Association, its individual members, any other organization, and members of the Bar to express their views on this suggested amendment on or before October 1, 1982, by amicus curiae brief or other writing.
