From the County Court, Jim Wells County, Texas
Trial Court No. 17-01-56823-CV
Honorable Michael Ventura Garcia, Judge Presiding
ORDER
On July 6, 2018, the district clerk filed a notification of late record stating that the clerk's record has not been filed because appellant has failed to pay or make arrangements to pay the clerk's fee for preparing the record and appellant is not entitled to appeal without paying the fee. Thereafter, we ordered appellant to provide written proof to this court that either (1) the clerk's fee has been paid or arrangements have been made to pay the clerk's fee; or (2) appellant is entitled to appeal without paying the clerk's fee.
In response to our order, appellant filed an affidavit of indigence indicating that he is entitled to appeal without paying the fee. Accordingly, the trial court clerk is ORDERED to file the clerk's record no later than 10 days from the date of this order.
