IN RE: MOTION FOR RECONSIDERATION


Motion granted. The Committee on Bar Admissions is ordered to allow relator, upon complying with requirements other than United States citizenship or residence, to take the bar examination commencing July 11, 1977. The committee shall grade and retain said examination pending further action by this court.

SANDERS, C. J., is of the opinion that the application should be denied on the ground that the applicant is not a resident alien as required by Article XIV, § 7(B)c of the Articles of Incorporation of the State Bar Association.

SUMMERS, J., dissenting. Since applicant is neither a citizen nor a resident alien, this court cannot administer the qualifications of lawyers in an evenhanded method unless it abides by its own rules.

MARCUS, J., dissents.
