IN THE INTEREST OF A.K.B. AND M.L.A.B., children

From the 73rd Judicial District Court, Bexar County, Texas Trial Court No. 2021-CI-04539 Honorable David A. Canales, Judge Presiding

ORDER

PER CURIAM

This is an accelerated appeal of an order terminating the Appellant M.B.'s parental rights, which must be disposed of by this court within 180 days of the date the notice of appeal is filed. TEX. R. JUD. ADMIN. 6.2. The reporter's record was due on March 10, 2023. Court reporter Gina May has filed three volumes. Court reporter Diana Guerrero has filed six volumes.

In an order dated March 27, 2023, we noted that we were still missing portions of the reporter's record for which court reporters Luis Duran, Delcine Benavides, and Maria Fattahi were responsible. We ordered those court reporters to file the portions of the reporter's record for which they were responsible on or before April 6, 2023. We noted that appellant had filed an affidavit of inability in the trial court.

Court reporter Luis Duran has failed to respond to our order. Therefore, we ORDER Luis Duran to file the portion of the reporter's record for which he is responsible within ten days of the date of this order. If the reporter's record is not received by such date, an order may be issued directing Luis Duran to appear and show cause why he should not be held in contempt for failing to file the record.

In response to our order, court reporter Delcine Benavides filed a notification of late reporter's record, stating that she had reached out to appellant's attorney regarding the cost of the record and not heard back. Likewise, Maria E. Fattahi filed a notification of late reporter's record, stating that appellant was not entitled to appeal without paying the fee for preparing the record and had failed to pay, or make arrangements to pay, the fee for preparing the record. Ms. Fattahi also stated that the trial court had denied appellant's statement of inability. The clerk of this court then called the trial court and was informed that although a hearing was held on March 9, 2023, no order had been signed.

We ORDER the trial court to sign an order regarding appellant's statement of inability within seven days of the date of this order. We ORDER the trial court clerk to file a supplemental clerk's record containing the trial court's ruling within ten days of the date of this order.

Given the time constraints governing the disposition of this appeal, requests for extensions of time will be disfavored.

It is so ORDERED
