ORDER
PER CURIAM
On the Court's own motion, it recalls its December 20, 2023 Order granting an abatement of the appeal and a motion requesting mediation. Any relief granted by the Order is withdrawn.
The Court further orders the parties to file a joint status report by 12:00 p.m. (noon) MST on December 29, 2023 that advises the Court of whether a mediator has been selected, whether a mediation date has been agreed on, and any other matter the parties reasonably believe will affect their ability to timely resolve the current appeal. Based on the response, parties should be prepared for the Court to thereafter issue a further order that may include an abbreviated briefing schedule.
