ORDER DISMISSING ACTION


On October 19, 2005, the Indiana Supreme Court Disciplinary Commission filed its motion to dismiss this action. In its motion, the Commission cited it inability to meets its burden of proof pursuant to Ind. Admission and Discipline Rule 23.

This Court, being duly advised, now finds that the Commission's motion should be granted.

IT IS, THEREFORE, ORDERED that this cause of action is dismissed.

The Clerk of this Court is directed to forward notice of this Order to the respondent or his attorney and to the Indiana Supreme Court Disciplinary Commission.

SHEPARD, C.J. and DICKSON, SULLIVAN, and BOEHM, JJ., concur.

RUCKER, J., not participating.
