ORDER OF INTERIM SUSPENSION
On August 22, 2011, the State Bar and respondent Kevin M. Gibbons filed a "Stipulation to Order of Interim Suspension." The parties have reached a settlement of the discipline matters that includes Respondent's stipulation to interim suspension effective September 5, 2011. The Court accepts the parties' stipulation to interim suspension.
IT IS ORDERED, pursuant to Rule 61(c), Rules of the Supreme Court, that Kevin M. Gibbons is suspended from the practice of law, effective September 5, 2011.
IT IS FURTHER ORDERED that the suspension shall continue in effect until final disposition of all pending proceedings against Kevin M. Gibbons, unless earlier vacated or modified.
IT IS FURTHER ORDERED that Kevin M. Gibbons shall not accept for representation any new cases, nor shall he agree to represent any existing client after the effective date of this Order, except to request withdrawal from representation as required by Rule 72(a), Rules of the Supreme Court. IT IS FURTHER ORDERED that following the effective date of this order, Kevin M. Gibbons is precluded from distributing funds from any trust account to anyone except with the written approval of bar counsel or of this court.
IT IS FURTHER ORDERED that pursuant to Rule 72(a), Rules of the Supreme Court, Kevin M. Gibbons shall notify all his clients within ten days from the date hereof of his inability to continue to represent them and that they should promptly retain new counsel, and shall promptly inform this Court of his compliance with this Order as provided by Rule 72(e), Rules of the Supreme Court.
IT IS FURTHER ORDERED that the presiding disciplinary judge's August 18, 2011 "Amended Order Imposing Terms, Conditions and Restrictions of Probation" is vacated, effective September 5, 2011.
