MEMORANDUM OPINION


The clerk's record is overdue in this appeal. See Tex. R. App. P. 35.1. On September 15, 2008, the Dallas County District Clerk filed a letter with this Court verifying appellant John McEntegart has not made payment arrangements for the clerk's record. That same day, we notified appellant of the clerk's letter and directed appellant to file within ten days verification he has paid or made arrangements to pay the fee for the clerk's record or written documentation that he has been found to be entitled to proceed without payment of costs. We further notified appellant that if he failed to comply, the appeal would be dismissed. Nevertheless, to date, appellant has not communicated with the Court regarding this appeal.

Accordingly, we DISMISS the appeal for want of prosecution. See Tex. R. App. P. 38.8(a)(1), 42.3(b).
