District Court of Appeal of Florida, Fourth District
Dec 31, 1980
391 So. 2d 785 (Fla. Dist. Ct. App. 1980)

Opinion

No. 80-368.

December 31, 1980.

Appeal from Circuit Court, Broward County; John A. Miller, Judge.

Richard L. Jorandby, Public Defender and Cherry Grant, Asst. Public Defender, West Palm Beach, for appellant.

No appearance for appellee.

The state has confessed error herein as to the lack of any evidence to support the trial court's finding that the appellant had committed a delinquent act. Our review of the record supports this confession of error in accord with appellant's contention on appeal. Accordingly, the trial court's order of July 16, 1980 is reversed and this cause is remanded for further proceedings consistent herewith.

LETTS, C.J., and ANSTEAD and BERANEK, JJ., concur.
