Iglesia v. City of Miami Beach

District Court of Appeal of Florida, Third District
May 6, 1986
487 So. 2d 1205 (Fla. Dist. Ct. App. 1986)

Opinion

No. 85-1408.

May 6, 1986.

Appeal from the Circuit Court for Dade County, Jon Gordon, Judge.

John R. Sutton, Miami, for appellants.

James F. Dougherty, II, Miami Beach, and Steven M. Weiss, Miami, for appellee.

Before BARKDULL, BASKIN and JORGENSON, JJ.

We find no error in the trial court's dismissal, with prejudice, of a second amended complaint against the appellee city, for failure to enforce its building regulations in regard to a building in excess of 40 years old. See Trianon Park Condominium Association, Inc. v. City of Hialeah, 468 So.2d 912 (Fla. 1985); Centrust Savings Bank v. City of Miami (Fla. 3d DCA 1986), 11 FLW 558.

Affirmed.
