District Court of Appeal of Florida, Second District
Apr 8, 1998
708 So. 2d 678 (Fla. Dist. Ct. App. 1998)

Opinion

No. 97-05103

Opinion filed April 8, 1998.

Petition for Writ of Certiorari to the Circuit Court for Charlotte County; Donald E. Pellecchia, Judge.

Bruce L. Scheiner of Associates and Bruce L. Scheiner, Fort Myers, for Petitioner.

Mark B. Yeslow of Troy Yeslow, P.A., Fort Myers, for Respondents.

Helen Humphries, plaintiff in a personal injury lawsuit, petitions this court for certiorari review of the protective order of the trial court prohibiting her from videotaping the respondents' deposition of her treating physician. This case is governed by our recent opinion in Ross v. Hobbs, 23 Fla. L. Weekly D255 (Fla. 2d DCA Jan. 16, 1998). Accordingly, we grant the petition, issue the writ, and quash the trial court's protective order.

Certiorari granted.

BLUE, A.C.J., and GREEN and CASANUEVA, JJ., Concur.
