JOSEPH ALBERT HULL JR., Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Joseph W. Nega, Judge.

This case is calendared for trial at the session of the Court to be conducted in person commencing on Monday January 9, 2023, in Indianapolis, Indiana.

The Petition filed February 26, 2021, and the Notice of Deficiency dated November 30, 2020, upon which this case is based each reflect petitioner's name as Joseph Albert Hull Jr.

On September 30, 2022, the parties filed a Proposed Stipulated Decision. The caption reflected on that decision, reflects petitioner's name as "Joseph A. Hull, Jr." which differs from the spelling as reflected on the Petition and Notice of Deficiency. Accordingly, the Court will strike the parties' Proposed Stipulated Decision.

For cause, it is

ORDERED that parties' Proposed Stipulated Decision filed September 30, 2022, at Docket Entry Index No. 13, is hereby stricken from the record in this case. It is further

ORDERED that, on or before November 2, 2022, the parties shall file a revised Proposed Stipulated Decision reflecting the correct spelling of petitioner's full proper name. If the parties are unable to file a revised decision, the parties shall file a joint status report (or separate reports if this is not possible) of the then-present status of this case.
