Opinion
No. 04-12-00630-CV
07-03-2013
From the 365th Judicial District Court, Zavala County, Texas
Trial Court No. 11-09-12583-ZCVAJA
Honorable Amado J. Abascal, III, Judge Presiding
ORDER
The clerk's record in this appeal was originally due on December 31, 2012. The Zavala County District Clerk has explained the lengthy delay in filing the record as due to difficulty in electronically filing a record that consists of over 3,000 pages. On July 2, 2013, in an attempt to obtain the record, the clerk of this court informed the district court that the record could be filed in paper form. On July 2, 2013, the district clerk filed a Notification of Late Record stating "because record is so voluminous I'm having problems numbering such volumes." The district clerk does not state when the record will be filed.
While we are sympathetic to the problems associated with electronic filing of large records, we note that this record has been due for almost six months. Rachel Ramirez is the district clerk responsible for preparing, certifying, and filing the clerk's record in this appeal. Ms. Ramirez is hereby ORDERED to file the record in this court no later than August 8, 2013. NO FURTHER EXTENSIONS OF TIME WILL BE GRANTED.
Because the trial and appellate courts are jointly responsible for ensuring that the appellate record is timely filed, the clerk of this court shall also cause a copy of this order to be served upon the trial court. See TEX. R. APP. P. 35.3(c).
