Annette E. Huckabone Petitioner v. Commissioner of Internal Revenue Respondent

ORDER

Patrick J. Urda, Judge

On September 21, 2021, respondent filed a motion for leave to file out of time notice of filing of petition and right to intervene, and subsequently lodged a notice of filing of petition and right to intervene (docket index #13) and filed a notice of filing of petition and right to intervene (docket index #14). Upon the Court's review of the notices at docket index #13 and docket index #14, it appears that docket index #13 does not contain the certificates of service upon the heirs at law, but the notice at docket index #14 does. We will grant the motion for leave and strike the notice at docket index #13. Accordingly, it is

ORDERED that respondent's motion for leave to file out of time notice of filing of petition and right to intervene is granted. It is further

ORDERED that respondent's notice of filing of petition and right to intervene lodged at docket index #13 is stricken from the Court's record.
