On the authority of Ex parte Houston, [Ms. 1972042, March 19, 1999] 740 So.2d 464 (Ala. 1999), the judgment of the circuit court is reversed and this cause is remanded to the Circuit Court for Houston County for proceedings consistent with the Supreme Court's opinion.
REVERSED AND REMANDED.
