Before the Court is appellant's August 7, 2023 motion to reconsider our July 31, 2023 order denying as moot appellant's motion to extend time to file his motion for reconsideration en banc. We GRANT appellant's motion and ORDER appellant's motion for reconsideration en banc filed on August 7, 2023 FILED as of the date of this order.
We DIRECT the Clerk of the Court to change the TAMES designation of the July 27, 2023 motion for reconsideration en banc to a motion for rehearing.
