MAGGY HORGAN, Appellant v. JOHN HORGAN, Appellee

On Appeal from the 328th District Court Fort Bend County, Texas Trial Court Cause No. 19-DCV-258949

Panel Consists of Justices Jewell, Bourliot, and Zimmerer.

ABATEMENT ORDER

PER CURIAM

Before the court is the parties' joint motion to abate appeal. Therein, the parties state that there have been difficulties obtaining videos that were admitted into evidence at the trial that resulted in the challenged divorce decree, and the parties seek to abate the appeal while they work with the court reporter to resolve issues related to those omitted parts of the reporter's record. See Tex. R. App. P. 34.6, 38.5(e), 77. The motion further notes that the parties anticipate the court reporter will do what she can to quickly address the difficulties. We grant the motion.

The court reporter for the 328th District Court is ordered to prepare and file a supplemental reporter's record within 30 days of the date of this order comprising the originals of the videos that were omitted from the original reporter's record, or copies of those videos.

The appeal is abated, treated as a closed case, and removed from this court's active docket. The appeal will be reinstated on this court's active docket when the supplemental reporter's record is filed with this court. The court will also consider an appropriate motion to reinstate the appeal filed by either party, or the court may reinstate the appeal on its own motion.
