Hopkins v. Tinklepaugh

Appellate Division of the Supreme Court of New York, Fourth Department
Oct 1, 1931
234 App. Div. 728 (N.Y. App. Div. 1931)

Opinion

October, 1931.

Present — Sears, P.J., Crouch, Taylor, Edgcomb and Thompson, JJ.

Judgment affirmed, with costs. All concur, except Crouch and Thompson, JJ., who dissent and vote for reversal on the law and facts upon the ground that findings of fact numbered 25, 26 and 31 are against the weight of the evidence and that under all the circumstances existing at the time of the transfer, including probable foreclosure, with resultant costs and deficiency judgment, a fair equivalent was given.
