ORDERED that petitioner's motion is recharacterized and treated as petitioner's response to the Order to Show Cause, served December 7, 2023. It is further

ORDERED that the above-mentioned Order to Show Cause is discharged. It is further

ORDERED that respondent's oral motion to dismiss for lack of prosecution, made December 4, 2023, is denied. It is further

ORDERED that jurisdiction over this case is no longer retained by the undersigned. It is further ORDERED that the case is restored to the general docket for trial or other disposition.
